Cromer Krup SL desarrolla el proyecto Culture Fit en colaboración con Altus Ventures SL (responsable de la producción ejecutiva). Cromer Krup SL develops the Culture Fit project in collaboration with Altus Ventures SL (responsible for executive production).

02 Objeto y aceptación Purpose and acceptance

Estas condiciones regulan el acceso y uso del sitio web culturefitworld.org y la aplicación móvil Culture Fit (conjuntamente "el Servicio"), que ofrecen información sobre el festival Culture Fit, sus espectáculos, sedes y procedimientos de postulación y colaboración. These terms govern access to and use of the website culturefitworld.org and the Culture Fit mobile application (jointly "the Service"), which provide information about the Culture Fit festival, its shows, venues and application and collaboration procedures.

El acceso al Servicio atribuye la condición de Usuario e implica la aceptación plena y sin reservas de estas condiciones, así como de la Política de Privacidad y la Política de Cookies. Access to the Service grants User status and implies full and unreserved acceptance of these terms, as well as the Privacy Policy and the Cookie Policy.

03 Uso correcto del Servicio Proper use of the Service

Te comprometes a utilizar el Servicio conforme a la ley, la moral, el orden público y estas condiciones, evitando especialmente: You agree to use the Service in accordance with the law, morality, public order and these terms, particularly avoiding:

• Realizar envíos masivos, automatizados o de naturaleza spam a través de los formularios.Submitting mass, automated or spam-like content through the forms.
• Suplantar la identidad de terceros o falsear datos.Impersonating third parties or providing false data.
• Intentar acceder a áreas restringidas, vulnerar medidas de seguridad o introducir código malicioso.Attempting to access restricted areas, breaching security measures or introducing malicious code.
• Utilizar el Servicio para fines comerciales no autorizados o competencia desleal.Using the Service for unauthorized commercial purposes or unfair competition.
• Reproducir, distribuir o explotar contenidos sin autorización (ver punto 5).Reproducing, distributing or exploiting content without authorization (see point 5).

Nos reservamos el derecho a denegar el acceso al Servicio sin previo aviso a quienes incumplan estas condiciones, así como a emprender las acciones legales oportunas. 04 Postulaciones y solicitudes Applications and requests

Postulación artísticaArtistic application

El envío de una postulación a través del formulario de postulación artística no constituye una oferta vinculante ni garantiza la participación en el festival. Culture Fit se reserva el derecho de seleccionar libremente las propuestas en función de criterios artísticos, técnicos y de viabilidad. Submitting an application through the artistic application form does not constitute a binding offer nor guarantee participation in the festival. Culture Fit reserves the right to freely select proposals based on artistic, technical and viability criteria.

Si tu propuesta es seleccionada, recibirás una comunicación al email facilitado y se formalizará un acuerdo específico con las condiciones de la colaboración. If your proposal is selected, you will receive a communication at the email provided and a specific agreement will be formalized with the collaboration conditions.

Solicitudes de partnersPartner requests

Las solicitudes de instituciones, sponsors, proveedores técnicos o medios de prensa serán evaluadas por nuestro equipo. Una solicitud no implica compromiso alguno; cualquier colaboración requerirá la formalización de un acuerdo específico por escrito. Requests from institutions, sponsors, technical suppliers or press will be evaluated by our team. A request does not imply any commitment; any collaboration will require the formalization of a specific written agreement.

05 Propiedad intelectual e industrial Intellectual and industrial property

Todos los contenidos del Servicio —textos, logos, marca "Culture Fit", diseño gráfico, fotografías, vídeos, código fuente, bases de datos y nombres de los espectáculos (Chakana, MVL, Sky Nazca, ACA FIT, Urban Garden, Virtual FIT, FIT Class)— son propiedad exclusiva de Cromer Krup SL o de sus respectivos titulares legítimos, y están protegidos por la normativa española e internacional de propiedad intelectual e industrial. All Service content —texts, logos, "Culture Fit" brand, graphic design, photographs, videos, source code, databases and show names (Chakana, MVL, Sky Nazca, ACA FIT, Urban Garden, Virtual FIT, FIT Class)— is the exclusive property of Cromer Krup SL or its respective legitimate owners, and is protected by Spanish and international intellectual and industrial property regulations.

Queda prohibida la reproducción, distribución, comunicación pública, transformación o cualquier otro acto de explotación, total o parcial, de los contenidos sin autorización expresa y por escrito de Cromer Krup SL. Reproduction, distribution, public communication, transformation or any other act of exploitation, in whole or in part, of the contents is prohibited without express written authorization from Cromer Krup SL.

Cromer Krup SL hace todo lo razonablemente posible para mantener el Servicio operativo, actualizado y libre de errores, pero: Cromer Krup SL makes all reasonably possible efforts to keep the Service operational, updated and error-free, but:

• No garantiza la disponibilidad ininterrumpida del Servicio; podrían producirse interrupciones por mantenimiento o causas técnicas ajenas a nuestro control.Does not guarantee uninterrupted availability of the Service; interruptions may occur due to maintenance or technical causes beyond our control.

• Las informaciones sobre fechas, lugares, programaciones y disponibilidad de los espectáculos pueden modificarse por causas operativas. Cromer Krup SL podrá modificar estos términos y condiciones cuando lo considere oportuno, especialmente por adaptación a la legislación o por cambios en el Servicio. Las modificaciones serán efectivas desde su publicación en este sitio web. Te recomendamos revisar periódicamente esta página. Cromer Krup SL may modify these terms and conditions when deemed appropriate, especially to adapt to legislation or due to changes in the Service. 09 Legislación aplicable y jurisdicción Applicable law and jurisdiction

Estas condiciones se rigen por la legislación española. Para la resolución de cualquier controversia derivada del uso del Servicio, las partes se someten a los Juzgados y Tribunales de la ciudad de Girona, sin perjuicio del fuero que pudiera corresponder al consumidor conforme a la normativa aplicable. These terms are governed by Spanish law. For the resolution of any dispute arising from the use of the Service, the parties submit to the Courts and Tribunals of the city of Girona, without prejudice to the jurisdiction that may correspond to the consumer under applicable regulations.
